* Ethically, and legally, at this moment of time, both the Complainant a dismissed Junior Assistant of a few years Service, and Shri Ranjan Gogoi the Chief Justice of India against whom allegations of Sexual harassment have been hurled, though holding a Highly Powerful and Responsible Post of CJI, both are to be deemed innocent. Here, Truth is more important than, the Respectability and Status of persons. But, we have to keep in mind that the Victim is a stressed and weak person who is battling against a person occupying third highest (after President, Vice President) Protocol position in India, the CJI.

* There ought to be a level playing ground between Contestants. How can we expect the Un-named little experienced former Junior Employee, who has just written her Law Examination, reported to be a dalit (may be correct or not), facing a trauma of herself dismissed, her other relatives dismissed, can face three Supreme Court Judges who are highly versed with legal intricacies? Sitting alone, may be with folded hands, before the three Supreme Court Judges, she must have been trembling in nervousness.

*Of course, some legal luminaries may be aiding her, abetting her, from outside, as is demonstrated by a well-drafted and well-reasoned representation made by her to the 22 Supreme Court Judges. This well-drafted long letter might have given rise to a suspicion of somebody instigating the Complainant, and given birth to a Conspiracy Theory.

* The three Judges, I feel, were in a hurry to decide the matter Ex Parte, as the Complainant expressed her resentment and started abstaining from the Inquiry. According to the Complainant, she was told that she was facing an Informal Inquiry, and not an In-house Inquire. Now, it turns out that the Inquiry is InHouse.

* The Disinclination of the Secretary General of the Supreme Court to place the InHouse Inquiry Report in Public Domain, taking shelter in the 2003 Case Indira Jaisingh vs. Supreme Court of India ANR(2003)5 SCC 494, only indicates that there is no transparency. A Transparent InHouse Report would have enhanced the Image of the Supreme Court. Now, the Educated Citizens of India, are forced to make their own unnecessary and sometimes prejudicial surmises.


question: How can you say that the Supreme Court Inquiry Team has not gone into depth of the Truth and Veracity of the issues raised by the Complainant?


Ans: The Complainant has expressed her apprehension that nobody in the Court will come to her rescue by giving evidence against the CJI. This apprehension has some basis. Who will give evidence against President of India, or Prime Minister of India, or the Chief Justice of India. The Complainant seems to be relying more on the Call Data Records (CDR) and Whatsapp Messages through which she has had some communications with the VJI. It seems that she wanted that those Call Data Records, Whatsapp Messages, are to be taken into consideration, while ascertaining the truth , or lack of truth of her allegations. As the Report of the Inquiry Committee Inquiry Committee is held as a secret, it is not clear whether they have cross-checked what the Complainant has stated with the CDRs and Whatsapp Message contents.

Ans: 10 or 15 days time to make an Inquiry is too short a period, for a critical and serious matter like this. Reason: The Complainant has alleged that she was chained in Police Station.

It is not that the Complainant is trying to tie a thread around Supreme Court and pull it, thinking that she will lose little if the thread is lost. On the other hand she has, having lost her own job, jobs of her close relatives, had already lost much. It is not dAram (thread).

There is another Telugu proverb. "konDaku tala bAdu kOvaTam". Here a person tries to hit his-her head by hitting it to a hill. There is a Legend (folk story) in which a poTTElu (RAM/ TUP or a male sheep with twisted horns) hits its head to a Hill-wall. The Ram can never succeed.
Anyway, it is very crucial that Nation should not lose its Confidence and Trust on the Apex Court as a Custodian of Justice and Truth. I hope the Supreme Court will make the InHouse Inquiry Report public, by placing it on its website.

E.g. Ms. Mamta Banerjee, Mr. KCR, Mr. Chandra Babu Naidu, Mr. Kumara Swami. Consequently, National Parties started resorting to Kickbacks on Defense Purchase Contracts.
