947 Part 2 of aftermath of collapse of Kesineni Travels, how Mr. Chandra Babu Naidu may or may not handle


In India, road transport system, seems to be in a mixed state in the sense that some States like Andhra Pradesh and Telangana have a well-developed Public Sector Road Transport Corporations equipped with thousands of buses covering thousands of kilometers and carrying millions of passengers everyday, whereas some other States like Bihar, Jharkhand, Eastern Uttar Pradesh have very underdeveloped private sector buses and potholled roof-torn bus stations. States with denser network of railway coverage, seem to be neglecting Public Sector Road Transport Corporations (hereafter I call them RTCs). In those States, politicians owning private bus companies seem to be obstructing the development of public sector RTCs. I had a few occasions of seeing some bus stations in a dilapidated and decaying State. 1) Gaya, Bihar. A District Head Quarter City. 2) Jamshedpur, also popular as Tata City having TISCO (Steel), TELCO (Automobile) Plants. In both the cities, I found the Public Sector RTC Bus stands and RTC Buses in a primitive state of maintenance and development.

ANDHRA PRADESH and TELANGANA STATES


In the United Andhra Pradesh State of prior to 2014 June, Andhra Pradesh State Road Transport Corporation used to be very strong, with international and national reputation for various parameters of efficiency. Now, we have two separate RTCs-- Telangana SRTC, and Residual APSRTC. Both the RTCs seem to be incurring operating losses, which are mainly attributable to 1) low occupancy ratios caused by cutthroat competition from Private Bus Companies. 2) High incidence of road and other taxes. 3) Failure of State Governments to compensate / compensate in time, for the concessions extended to various classes of bus pass such as a) student passes b) Govt. Employee passes. 4) Not permitting Public Sector RTCs to raise charges in proportion to increase in costs.

ROLE OF VIJAYAWADA BASED PRIVATE BUS COMPANIES IN MAKING APSRTC SICK


Everybody knows that Vijayawada based Private Bus Companies played a major role in lowering the occupancy ratios of APSRTC Buses. The Private Bus Companies were taking permits to ply CONTRACT Buses (To run them on whole bus contract basis for purposes such as marriages, pilgrimages, with predetermined starting point, terminus, with no intermediate boarding/alighting), but were running them as Stage Carriages (With provision for boarding and alighting by passengers, issuance of tickets enroute, employing conductors on the buses). The Private Bus Companies specialised in HEAVY TRAFFIC LUCRATIVE PROFITABLE ROUTES such as Vijayawada-Hyderabad, Vijayawada-Visakhapatnam, Vijayawada-Bengaluru, Vijayawada-Shirdi. They have no burden of running buses to non-profitable rural routes, called 'palle velugu' in Telugu (English: rural lights). Nor do they have to honour/issue free Student Bus Passes. APSRTC has been burdened with everything. This lacuna, every ruler of Andhra Pradesh, both past, and present, knows. Yet they do not have any sympathy towards APSRTC. On the other hand, rulers themselves have started owning and running Private Bus Companies in hidden-benamy names.

946 It is high time that Public Sector Transport Corporations are strengthened in India


On 1st April 2017, The Hindu.com reported that Kesineni Travels, Vijayawada, owned by Shri Kesineni Nani, MP from Vijayawada, is closing. Here is a quote from the report:

“The MP is upset over repeated accusations that the private travels mafia is pulling the strings. So, he has decided to quit the transport business with a sole objective that his business interests should not bring disgrace to the party (TDP),” said sources close to Mr. Nani.

The MP has been at loggerheads with the officials demanding action against the errant private travels. Mr. Nani and Vijayawada (Central) MLA Bonda Umamaheswara Rao were pulled up by the Chief Minister following their apparent rude behaviour with Transport Commissioner N. Balasubrahmanyam. Subsequently, they apologised to the Transport Commissioner.


After the Meeting of Shri Kesineni Srinivas (Nani), with Shri Nara Chandra Babu Naidu, with the Chief Minister of Residual Andhra Pradesh, it appeared as though Mr. Srinivas has relented, and that Kesineni Travels will continue as hitherto.

It appeared as though Mr. Nani was just trying to pressurise Mr. Chandra Babu Naidu, so as to soften him towards the Private Travels Businesses in Andhra Pradesh, particularly his own business, after the fiasco of TV Exposures of Rude Conversations of TDP Leaders with the Dy. Transport Commissioner , and his being subsequently compelled to tender an apology to the hurt RTA & IPS Officer, who was appealing to him with folded hands.

Mr. Naidu has done him a favor, by treating the matter as closed, without allowing the law to take its own course, as the matter is serious in the sense that a Public Servant was prevented from discharging his duties.

There is a Telugu proverb: "GAliki pOyE pEla pinDi krishNArpaNam". Approx. English: The popped flour flying away in the wind, is offered to Lord Krishna. The purport here is: The flour is going anyway, why not we offer to God and get 10 times in return! Anyway there are losses, time has come to close the business. Then why not do it in a lofty way saying "my business interests should not bring disgrace to the party (TDP)"

Now, we can get an impression that prior to meeting the Dy. Transport Commissioner itself, Mr. Nani seems to have made up his mind to close up his Travels Transport Business, may be due to extremely cut-throat competition from Private Travels operating from other States like Telangana and Arunachal Pradesh. He might have wanted to impress on the Dy. Transport Commissioner about the need to take stringent action/steps against competitors from other States like Orange Travels, which many people believe is secretly owned by Mr. Y.S. Jaganmohan Reddy. But, somehow,it might not have materialised.

Besides, prior to bifurcation of United Andhra Pradesh, the Travels Business between Hyderabad and Vijayawada, and Hyderabad-Rajahmundry-Kakinada-Visakhapatnam used to be dominated by Vijayawada Travels Owners. After the dis-section of the State, two State Transport Authorities one at Hyderabad, and the other at Vijayawada, had emerged. This might have resulted in double payment of bribes, like a candle burning at both ends. It might have led to losses of travel operators from Coastal Andhra.

After the Divakar Travels' Bus Accident at Mullapadu, Jaggaiahpet Mandal, in which 10 passengers were killed, the bus being owned by the family of a Telugu Desam MP from Anantapur, Telugu TV News Channels have profusely highlighted the violation of CONTRACT BUS PERMIT TERMS, and PLYING THE CONTRACT BUSES AS STAGE CARRIERS. This might have at least partially forced the Government and the Transport Authority Officials to mount their rides, insisting on compliance with the Contract Carriage Permit Terms. This might have made the Private Travel Business in Residual Andhra Pradesh, non-viable, and hazardous, as at every stage, bribes will have to be paid.

Has the MP been hurt, by non-inclusion of his representative in the State Cabinet?


The MP might have insisted that his representative Mr. Bonda Uma Maheswara Rao be inducted into the Cabinet, which could not take place owing to various permutations and combinations relating to caste and District.

Many websites on Internet support this view. Even otherwise, commonsense will support this view. Elections in India are not a joke. 'Unbearable expenses' make India's Parliamentary Democracy a joke. All the Political Parties in the country, including the Left Parties mobilise Corporate donations. While parties mobilise Corporate Funds on a massive scale, they may not be distributing the funds to the Contestant candidates at grassroots level. After spending some amounts for printing publicity materials, for releasing newspaper and TV ads., after paying hires of charatered aircraft, remaining booty the political parties may be hiding with themselves, or remitting abroad for credit to secret numbered accounts.

HEAVY BURDENS ON CONTESTANT CANDIDATES


If contesting candidates are forced to spend their own money-- not only to get themselves elected, but also help the Assembly Candidates in their Lok Sabha Constitutency, poor candidates from Weaker Sections in the adjoining Constituencies, the MP contestants will get soaked with expense bills of all types. Those bills will affect the personal businesses of the contestants, making them to borrow from money lenders. If they get opportunities to recoup their expenses in their five year term as early as possible, their businesses will re-enter the progressive track, else their businesses will derail and everything will be topsy-turvy.

It happened at about 18 years back. My son was writing a Medical Entrance Test conducted by Karnataka State in Bengaluru, Karnataka State. I and my two sons visited Bengaluru. For return journey, we could not get train/APSRTC reservation towards Vijayavada. Consequently, we were forced to book a Private Travel ticket, and that happened to be Kesineni Travels. AS staying expenses were heavy, we had limited money for boarding and lodging, inasmuch as in those days there were no ATMs, we could not afford to stay longer in Bengaluru, Though I myself personally disliked to travel in a Private Bus, there was no alternative.

Ahead of the the stipulated time, we boarded the bus, and occupied our seats. Later three other passengers boarded the bus, and demanded us to vacate our seats, as according to them, they are reserved for them. We saw their tickets. They too were having valid tickets booked with the same seat numbers, same trip, same date etc. Some minutes later, the Driver came and asked us to vacate the seats and give them to the other claimants. We protested and resisted. The driver laughed and said: "It is common here to allot same seat numbers to different persons. Our experience shows that some people cancel their tickets later and before the bus starts, and we accommodate the waiting standing persons to occupy the seats falling newly vacant."

Then, I threatened the Driver/his assistant to drag their Travels to Consumer Forum. I do not know why, the driver did not say 'Do as you like. But vacate the sat'. Instead, he asked the other persons to get down, or proceed as standing passengers. They preferred to continue as standing passengers upto Vijayawada. (Bangalore is very costly!!! Nobody can afford to stay).

Then the driver/his assistant, made those three persons to sit in seats reserved for towns ahead.

At Madanapalli or Piler (I do not remember exactly), a pregnant woman and two of her relatives boarded the bus. Then driver's assistant asked the previous three persons to vacate the seats and give them to the pregnant woman and her two relatives, for whom the seats were reserved in advance. Those three persons did not accept. They started shouting, for the mismanagement.

Now, the driver's assistant asked the pregnant woman and her aids to sit on a flat wooden pITa (used in homes for dining on floor), laid by him on the floor of the bus, between the rows. That pregnant woman stretched her two legs, and tried a lot to continue her journey sitting on the wooden plate. Her situation became pitiable. Unable to see it, I vacated my seat and asked her to occupy my seat. She thanked me, and traveled in that seat upto Vijayawada. At Ongole or Kavali, a passenger got down, and I could get another seat.

After reaching home, I wrote two letters to Kesineni Travels, Vijayawada, bringing to their notice, how a pregnant woman was made to travel from Pileru to Vijayawada, sitting on floor-wooden-pITA. No reply was received from them. I thought that Private Sector fellows would not reply, and writing them would be hitting one's own head to a rock. I left it.

945 Should Incredible India be built on the foundation of booze? If we study this Times of India Article, it appears so!


Here is a link to an article in the TimesOfIndia Editorial Page, titled " 'Incredible India' hollowed out by court-ordered alcohol ban, just when India's dining scene was turning world class", author Mr. AmlinAli@Timesgroup.Com. Then, they have to permit me, to exercise my freedom of expression, and criticise it, within my limits and limitations. The Article gives an impression that India can attain a World Class Dining Scene only with booze. It also gives an impression that Incredible India has been hollowed out by the recent Supreme Court Judgement barring Liquor Shops and Bars on Highways and within 500 meters of Highways. The Supreme Court of India Judgement might have had an object of preventing accidents caused by drunken driving. This blogger ybrao-a-donkey personally believes that Supreme Court of India ought to have advised the State and Central Governments to design and implement Plans for Introduction of Prohibition on an intensive and extensive scale.

We shall start with some quotes from the Times of India Article, which are worth examining:--

A five star hotel was fully booked to host the top performers of a leading bank from across the globe. Their hosts’ plan was to showcase India as a premium luxury travel destination that boasted world class premises. A part of their stay involved a gala dinner where these executives could sample the finest selection of wines and enjoy a tour to a bustling food hub nearby. Which is this Bank? Definitely, it must have been a Private Sector Bank. Even if it be a Public Sector Bank (PSB), it does not appear to be doing the right thing.
What Banking has to do with boozing (Euphemism: Sample the finest selection of wines). Will India become a luxury travel destination only by offering booze? Doesn't India have anything else to offer to attract tourists? What is all this stuff "that boasted world class premises"? Did the TOI article writer borrowed this phrase from Mr. Nara Chandra Babu Naidu, Chief Minister of Andhra Pradesh.
The Indian hosts are wondering how to tell their foreign guests at the last moment that they have been ‘banned’ from serving alcohol. The hotel manager explains the word ban freaks out a lot of travellers and causes irreparable damage to an establishment’s reputation. There is no bar on serving alcohol. Only thing is, it should be served at a place which is located 500 meters away from the Highway. Anyway, our Hotels, Bars, Wine Shops have the necessary INFLUENCE and CASH to bribe the officials for conveniently circumventing the 500 mts. distance. They can find loopholes in Govt. Orders, in such a way that every hotel/bar/wineshop is shown as have been relocated to places beyond 500 meters. What type of travellers are these, who cannot perform their journeys/tours without booze for a fortnight? Actually, they should be happy that they are getting an opportunity to stay away from booze at least during their tour, which pleasure/addiction/habit was haunting them since their adolescence, robbing their hard-earned monies, health, peace of mind, and above all their time to spend with their wife and children?
National Crime Records Bureau data of 2015 on road accidents shows that out of a total 4,64,674 road accidents that year, 7,061 or 1.5% were due to driving under influence (DUI) of drugs or alcohol. Dangerous or careless driving, overtaking etc was the reason for 31.4% of road accidents whereas speeding caused 43.7% accidents. This suggests that strict enforcement of existing traffic and road safety rules will curb accidents far better than closing down bars and restaurants. Whoever has compiled these statistics, they do not appear to have done their homework properly. Careless driving, overtaking etc. numerous traits of dangerous driving also result when a drunken-driver loses control over himself.
Secondly, the judgment clubs liquor vends with bars and restaurants within and outside the hotel. A restaurant is a highly regulated space set up after going through various inspections and licensing. It is one legally permitted place where one can enjoy a drink responsibly with friends and family. Each of these spaces was established after a hefty licence fee and paid heavy taxes on every pint or peg sold. Heavy incidence of taxes, licence fees does not justify the evil of alcoholism. The author of the article seems to be deliberately under-rating the evils of alcoholism. What are all these inspections carried out by Govt. Officials? What is this regulated space? They are all figments of imagination.
It is important to understand that most of the places paid a premium to set up shop in areas designated for hotels or food outlets by city planners. When many of these places came up, the roads may not have been national or state highways and may have just been city roads. As cities grew, many roads developed into arterial highways. Bars and wine shops seem to pay high rents and premia to set up their businesses, because their business is very lucrative, as they thrive earning super profits, exploiting the weaknesses of innocent / feeble /addicted people.
A consideration in buying residential property nowadays is recreation options nearby. To suddenly be told that the bar across our residential society cannot serve liquor as the road has become a highway amounts to forcing a resident to drive further for his drink. As far as my understanding goes, howsoever foolish it may be, residents of localities do not want bars / wine-shops in their area, as liquor shops and bars create serious law and order problems.
Bars, restaurants and hotels are a reflection of our evolution. They are signs of a booming economy and a cosmopolitan society. Any popular tourist destination boasts of a vibrant food and nightlife and strong law enforcement that gives a sense to security. India had a happening food scene, what was merely needed was to provide stronger security that implemented rules strictly. What type of Evolution is this? Every alternate home in India today, we can find at least on drunkard who beats his mother/wife for money to buy liquor. Children with alcoholic fathers tend to be the worst sufferers in our society. Actually, Mahatma Gandhi dreamed of a State where there will be no need of any Government, and where there will be no need of Police. Every Citizen should naturally have a sense of security, without the presence of any Law Enforcement Agencies, strong or weak.
To suddenly order that our favourite places to unwind after a taxing working schedule are no longer permitted to serve us our hard earned drink is depriving us of simple joys of life. A vend will still pick up its makeshift structure and hop 500 metres away from its present location to sell liquor. But a bar that came up after huge investment and employed security guards, trained waiters and talented bartenders will simply have to shut shop, rendering them jobless and consumers without a safe drinking spot. Loss of jobs and, unemployment cannot be an excuse for allowing Bars/Wineshops/Governments to rob people. If they want to rob citizens, better way will be to do it directly, at gun-point.
For me it is taking away the essence of my ‘Incredible India’ where i can enjoy the finest of food and alcohol in my city. An India where i have the freedom to party but also awareness of my responsibility and rules. Most alcoholics start their lives with AWARENESS OF RESPONSIBILITIES AND RULES. But when the habit gets deep-rooted into their blood and veins, awareness of responsibilities and rules, will be replaced by helpless surrender to an irretrievable addiction.

944 There is no proof of Ravana trying to trying to lift Shiva's Bow in Valmiki Ramayana

Today is Shri Rama Navami. It is regarded as the birth day of Shri Rama. It is celebrated with great gaiety in India. Telugu People celebrate it with greater delight, when compared to people of other States of India. Reasons, I do not know. At Bhadrachalam, Shri Rama's Temple, the wedding of Shri Rama and Sita is celebrated with great gusto. Bhadrachalam is believed by Telugu People, to be the Panchavati Cottage on the banks of River Godavari, from where Sita was abducted by Ravana, during the 14th year of Shri Rama's exile to forests. Of course, Nasik in Maharashtra also competes for the same credits. The Government of Telangana State sends new clothes, pearls to the Bhadradri Temple,as a token of respect. This practice of Golkonda Nawabs sending clothes and pearls seems to be in vogue since 1700 C.E., when TanIsha was the Ruler of Golkonda. When compared to the Towns and villages of Telangana State, the towns and villages of Residual Andhra Pradesh, organise the weddings of the deities Sita and Rama with greater enthusiasm. This enthusiasm used to be far larger about 40 years back. After formation of the State of United Andhra Pradesh in 1956, and the mingling of the people of Residual Andhra Pradesh commenced on a larger scale, because of movement of Andhra People to Hyderabad (State Capital) for livelihood, there is a shift in celebrations from the Weddings of Sita and Rama to the Celebration of Ganesh (Vinayaka) Worship. 40 years back, there used to be big pandals in Residual Andhra Pradesh for celebration of the wedding of Sita and Rama. Today, we do not see such pendals. We see such pendals for Ganesh Worship.

FOR RAMAYANA RELATED EPISODES & NARRATIONS, VALMIKI RAMAYANA SHOULD BE THE AUTHORITY AND BASIS.


Valmiki is regarded as the First Poet (Adi kavi) in Sanskrit language, and India. Valmiki Ramayana is regarded as the first book/Epic in India. If that is acceptable, for all Ramayana related narrations and episodes, analyses, Valmiki Ramayan should be taken as standard, authority, and basis. Other Ramayanas may contain different narrations. For research analytical purposes, other Ramayanas cannot be taken as standard. Similarly, we should not be carried away by the misleading versions in films, and TV Serials. It will be in the interest of Readers to check correctness of events shown in films/TV serials, by referring Valmiki Ramayana.

WHY I AM HIGHLIGHTING THIS?


There is an erroneous impression among many Indians, and of course Telugu people especially, that Demon King Ravana was present at the venue of Sita's Svayamvara (Sita selecting her life's partner). Many films present that, before Rama, Ravana tried to lift Shiva's Bow, and having failed, went back, disappointed. Films also show that the bow fell on Ravana.

This is not true, as per Valmiki Ramayana, Volume 1 Balakanda, Chapter 62 Sarga 62. Here are the verses from Valmiki Ramayana, which were spoken by King Janaka (Sita's father) to Sage Viswamitra, with a very brief English gist. These verses mention that many kings tried to lift Shiva's bow, and having failed in their attempt, they laid a seize on the Mithila City, Provisions get exhausted after one year, anxious king Janaka prays Gods, gets forces to chase out the Kings. These verses do not mention that Ravana was among the Kings who tried. In the last verse, King Janaka offers Sage Visvamitra to show the bow to Rama and Lakshmana. Thus, it can be seen that when Rama broke Shiva's bow, neither Ravana, nor any other kings were present in the Hall. All such scenes are 'cinema-creations'.

Late N.T. Rama Rao, Former Chief Minister of Andhra Pradesh, directed a film titled 'SItA rAma kalyANam' (wedding of Sita and Rama). In that film he had even introduced a duplicate Sita, a duplicate Ravana, and produced some dramatic effects. All such scenarios and stories are fictitious and cannot be taken as real, if we accept Valmiki Ramayana as standard.

Film Director Late Bapu, (also a cartoonist and painter of great calibre), directed a film by name Sampurna Ramayanam (Complete Ramayanam), with Hero Shobhan Babau as Shri Rama and Chandra Kala as Sita. I have seen a part of this film, on E TV Cinema. This film also contains a scene of Ravana (S.V. Ranga Rao) attempting to lift Shiva's bow, and failing in it. As per Valmiki Ramayana, this cannot be accepted.

When the Shiva's bow was brought near the Kings, they were neither able to lift it or handle it.

Finding their lack of strength and valor, I have since then barred the kings from seeing it.

Today, TV Channels, particularly Telugu TV channels have done lot of preaching, about virtues of Shri Rama, the maryAda purushOttama, as a person who treats every creature in this Universe equally, with compassion. But none of the TV Channels mentioned about the story of 'Shanbuka vadha' which can be found in Valmiki Ramayan's last volume, Uttara KAnDa also called 'uttara rAmAyanam'. uttara RAmAyanam describes Rama rAjyam (Shri Rama's glorious Administration).

A very brief STORY OF RAMA SLAYING SHAMBUKA


Shambuka was a person of 4th caste (ShUdra or a servant caste of thos days). He was performing penance. One day a Priest came to Rama's court, with a grievance. According to the Priest, his son died, because a violation of 'virtuosity (dharma)' took place. Violation: A Sudra was performing penance, which he was not supposed to do. Hearing of the volation, Shri Rama with his sword, went on his Pushpaka Aircraft to danDaka forest, searched the penancing ShUdra Shambuka, and beheaded him.

943 Mr. Ram Jeth Malani, Senior Supreme Court Lawyer's offering to Arvind Kejriwal, to argue freely in his defence against Finance Minister Arun Jaitley, is intriguing.


Reports indicate that Mr. Ram Jeth Malani, Senior Supreme Court Advocate, Former BJP Top Leader, Former Law Minister, has initially sent a bill of about Rs. 38 million as fees, and expenses to Mr. Arvind Kejriwal, Delhi Chief Minister. It appears that Mr. Kejriwal wanted to pay the bill from the Exchequer of the Delhi Government. There are reports which indicate that Mr. Sisodia, Delhi Dy. Chief Minister wanted the Delhi Govt. Officials to clear the bill, without sending it to the Delhi Lieutenant Governor. But, that was not so easy. Hence, according to Media Reports, Mr. Ram Jeth Malani has come forward to argue the defence of Mr. Kejriwal, FREELY treating him as a poor client. There will be nothing wrong for a State/UT Government to defend in Courts, the actions / communications of its functionaries / officials, as long as their communications are made in their official capacities, following proper procedures, at proper fora.

If the 'defaming' comment is made by Mr. Arvind Kejriwal, in his capacity as Chief Minister of Delhi, then, it will be reasonable for him, and Mr. Ram Jethmalani to expect that its DEFENCE BILL is to be paid by the Government of Delhi. How to distinguish official comments from private personal comments?

Solution 1:


Reproduce all comments / allegations made by the Chief Minister of a State, in writing. Writings are to be made on Official Letterheads. After the affixing signature of CM, it is better to add his Office Seal. Before and above the signature of the Chief Minister, it will be better to add "For and on behalf of the Government of Delhi". In case of digital / email / electronic communications, wherever possible digital signatures and encryptions can be added. In case of oral comments / observations, an Official Videographer who should be an employee of the Delhi Government, can be employed to produce duly recorded videos, and its copies.

Approvals for Expenses


While the Chief Minister or his Dy. Chief Minister cannot be sole judges to decide on whether to bear the expenses on behalf of the State, I believe that everything cannot be centralised into the hands of the Governors / Lieutenant Governors who now-a-days act as Clerks of the Central Government.

In India, even State Cabinets tend to be slaves of Chief Ministers, and Central Cabinets tend to be the slaves of the Prime Ministers, and hence the question of defending CMs/PMs at State Expenses cannot be left to the Cabinets.

Better to obtain approvals from Legislatures


Though not a perfect solution, it will be better, if the decisions are taken by State Assemblies, and in case of Prime Ministers- by the Parliaments. For the purpose Approval Resolutions can be proposed in the Lower House, the reasons and the circumstances which have led to the legal cases can be discussed, and approval to defend the cases at the expense of State Exchequer can be given. This is on the assumption that our Legislatures will be filled with members who can view problems objectively, independent of party affiliations.

These proposals for sanction of funds to bear expenses to defend cases against Government functionaries (both politicians and bureaucrats), should as far as possible be present before the Legislatures for prior prior approval, giving approximate estimates of likely expenditure, name of the advocates proposed, break up of their fees for various purposes, other expenses etc. Only in exceptional emergencies, post facto confirmations /ratifications can be obtained from Legislatures.

CLAIM OF SHRI RAM JETHMALANI THAT 90% OF HIS CASES ARE FREE CASES ON BEHALF OF POOR


I am unable to believe it. But he is a NONAGENARIAN. Difficult to doubt him. However, I believe, as citizens, we expect him to disclose the names of the poor persons/institutions he argued FREE, with some details such as nature of dispute, year, court, success/failure etc. He can place these details on his web page / social media page. There is nothing wrong in cross-subsidisation per se (Charging the Rich, and serving the poor). Even doctors and Hospitals can do it, but they do not seem to undertake such useless things (useless things in their opinion), except in the Returns they submit to the Government, if at all they submit, when required by law.

Wherever / Whenever possible, State Assemblies can pass Resolutions ratifying the statements made by Chief Ministers.

WHY DO MANY STATE GOVERNMENTS BELIEVE THAT THEY CAN DEFEND SUCCESSFULLY/WIN CASES ONLY WHEN THEY APPOINT A HIGH PROFILE LAWYER?


Governments are supposed to be RATIONAL ORGANISATIONS. They cannot afford to be irrational, and citizens/voters will have to dump irrational Governments, when they get opportunity to vote.

Usually film producers, distributors entertain irrational beliefs that their films will rake heaps of moolah only when they make films with Mega Heroes such as Salman Khan, Shah Rukh Khan. Rajani Kanth. But Governments should not have such fallacious beliefs that they will win cases only when they employ high profile lawyers. The success of a film depends largely on its storyline, and to some extent on the treatment given to it, i.e. the manner in which it is presented to the audience. The same is the case with recipes, beverages such as coffee, tea, where tastes and flavours emerge from the quality and quantity of the ingredients used. In case of suits, their successes or failures depend on basically on 'justice is on which side'. The manner in which the Counsel presents the case may initially impress judges, but ultimately the ratio decidendi will depend on the strength of the CAUSE OF JUSTICE. Of course, evidences and arguments have their value, in affecting the judgement, but they cannot make UNJUSTIFIABLE CAUSES, JUSTIFIABLE.

Then, what is expected of/from a Counsel? What is expected from Judges?


Counsel should not be negligent or lethargic. He-she must be alert. And of course, the Judges have to give sufficient opportunities to the Counsels.

The general impression among many lawyers all over India is that :
*High profile lawyers get encouragement from Judges, while starters are treated like a Cinderella in her mother's house.
*High Profile lawyers can get their cases heard early,
*High Profile lawyers can get easy adjournments when needed.
*High profile lawyers can confuse or pressurise judges.
Etc. Etc.

COURTS HAVE TO DISPEL THE ERRONEOUS BELIEFS OF STARTER ADVOCATES


And these beliefs, may they be only misconceptions, lead to HUGE DEMAND FOR HIGH PROFILE LAWYERS, LEADING TO MILLIONS OF BUCKS THROWN AWAY BY CLIENTS AS THEIR FEES, while poor lawyers starve. It is high time that Supreme Courts and High Courts take adequate steps for dispelling this type of apprehensions among lawyers and clients. After all, Lawyers are intended only to assist the Judges in arriving at truth, and they are employees of the Court. Though fees is paid by clients, lawyers are not supposed to be the SERVANTS AND SLAVES OF THE CLIENTS.

State and Central Governments should not fall into the above type of pits, of appointing lawyers only by their name, and demand.

COURTS SHOULD APPOINT LAWYERS FOR BOTH THE PARTIES


When clients are given freedom to chose their own lawyers, rich clients chose high profile lawyers paying millions as fees. Poor clients are left with residues. The impression that High Profile Lawyers are geniuses capable of winning cases, and that low profile lawyers are duds make no sense. Heroes charge millions for acting in films, and their films bomb at box office. There are several simple straight cases argued by HIGH PROFILE LAWYERS which have failed in getting even simple remedies. This is because Lawyers do their duty. Judges do their duty. Hence, clients have to shed their foolish beliefs. Can we expect that Supreme Court/High Courts will create an environment which melts away the mists and smogs before the clients' eyes? Or will they call us to court and convict us for Contempt of Court?

942 Do people really gain or lose, if bars and liquor shops on highway are closed as per Supreme Court's Verdict?


Anyone who is seriously interested in the welfare of Citizens of India, should be happy with the Supreme Court's verdict that liquor shops and bars on Highways, and within 500 meters distance of Highways are to be shifted. This decision seems to be based on a strong logic that no driver can resist a temptation to booze, when liquor shops and bars are available on the vicinity. When drivers yield to inebriations, their vehicles will indulge in gyrations. The end result will be bloodbaths on Highways. It is not the families of the drivers alone who will fall on the roads, but also the families of the persons trampled by the chariots of death driven by drunkards. Of course, General Insurance Companies may be paying claims to the vehicle owners and the third party sufferers. But, money is not a substitute for lives, the value of which cannot be measured with pink notes. The Highway Bars and Liquor shops are used not only by the vehicle drivers plying on the highways, but also the nearby residents, business persons, industrialists, professionals, students, engineers, doctors, and who else not?

Media and the State Governments should have wholeheartedly supported the verdict of the Supreme Court. Of course, some concessions such as giving additional time of about three months, or waiting for the completion of the Excise Year/Financial Year, some minor adjustments may be sought and granted. But strangely, both the Media and the State Governments are trying to defend the proliferation of bars and liquorshops on highways, on some pretext or other. We shall see one such example, a TimesofIndia.com editorial.

Even the man whose PIL led to the highway liquor ban – Chandigarh-based activist Harman Sidhu – has said he never wanted popular watering holes within city limits to shut down.

As always, measures to ramp up governance will work far better than radical decrees. Policing should improve on highways to tackle drunken driving. State governments should be directed to allocate more resources for this purpose. Only constant checking of drivers and punishment for offenders can deter those who drink and drive. Blanket bans and prohibition-like decrees, whether from judiciary or legislature, only make the problem worse. In this case they will injure the economy and cripple the tourism industry – which happens to be the sector that produces the most jobs per rupee invested. The apex court must reconsider its decision.

There is an idiomatic phrase in Telugu language "bellam chuTTU IgallAgA", which approximately in English reads: "like flies around jaggery". This adage refers to flies swarming around jaggery गुड బెల్లం . Just as flies swarm around jaggery, hotels, young persons and foreign tourists swarm around highways. Readers may recall how Casinos on the beaches of Goa, have converted the beautiful joy-generating Arabian-Seaside Heaven into a gambling den, suitable for drunken brawls. Our Former Defence Minister of India Shri Manohar Parlikar, as Goa's CM, seem to encourage their flourishes.

Highways are intended for transportation of essential goods. Not for boozing

They are not intended for boozing binges. Extension of period for closure of highway bars and liquor shops, is a way of consoling fhem for loss of their business owing to abrupt closures, and shifting the shops. Besides, the aficionados and connoisseurs of liquors are simply not muggins to stop searching for boozes and drive their vehicles with lotus-petal-wide eyes. They will stop the vehicle on the Highways, go into lanes in search of bars and liquor shops, fill their barrel-bellies, and return to their vehicles self-coiling and self-winding, like ringworms.

Allowing proliferation of bars and wine-shops on and around highways indicate that there are Governmental failures. Some bureaucrats / politicians handling the tasks of governance might have been making quickbucks by granting licences.

TimesofIndia.indiatimes.com editorial dated Apr 3, 2017, titled 'MEAT UNDER ATTACK' does not appear to be reasonable. The overall impression we get from reading the Editorial, as per my perception, is that India cannot generate employment to its 1300 million people, without meat production and meat exports. Workers in India will starve, if abattoirs are closed. It may be partly true. The Editorial sees the problem only from a commercial angle. Only from money angle. Only from business angle. That perspective may be respectable in Nations which have brutal cultures. But not India, which is supposed to be a land which gave birth to Great Souls like Gautama Buddha, Vardhamana Mahavira and 24 Tirthankaras, Mahatma Gandhi, Kabir, Jimutavahana, Sibi, Mandhata et al. This editorial has pained me substantially, because since 1991 to 2017, owing to the defective Economic policies of the Rulers, in the guise of Economic Reforms, millions of people lost their employment, thousands of the displaced persons committed suicides, families of many displaced persons underwent immeasurable deprivation and misery. Yet, none of the Corporate Bosses of India Inc., and the Media they own have never raised any objections, or at least expressed any unhappiness or concerns over the displacement/unemployment of millions. Now, suddenly, why this extra-ordinary sympathy they are expressing for this meat production and meat exporting businesses, on the ground of unemployment of meat-workers?

During the last 1000 years of hegemony of foreign invaders, when jijia tax was levied, pilgrimage tax was levied, 1 out of 3 bags of grain harvest was collected as land revenue, Indians survived by what? Did they survive by slaughtering their milch cattle and draught cattle? Nay. Indians survived by eating a few green chillies, a small chunk of onion, a pinch of salt with rice/jowar/wheat/bajra gruel. Sometimes, they starved with empty bellies.

A Note of Caution


Compassion towards animals cannot be forced on citizens by law or the rulers. People have to cultivate it gradually, by self-education, self-enlightenment. Undue haste on the part of rulers can lead to negative results. Recall how Sanjay Gandhi's haste for forced sterilisations led to a repulsion in the minds of people towards family planning, and the population of India went upto 1300 million.

Voluntary vegetarianism has its economic benefits, apart from health benefits, emotional-peace and tranquility benefits.

It is also saddening to note that a culture is developing, where people will be eager to devour meats from airconditioned slaughterhouses, because the so-called gentle meat buyers and eaters do not want to see the bloodshed and cruelty in slaughterhouses.

939 This is the Curse of Capitalism! It makes Bachelors of Technology, foolish devils!!!


Why do we study B.Tech? To earn food, clothing, shelter, old age security, some essentials like medicare, education for children, and above all some dignity of labor, and dignity of life with self-esteem, some element of self-actualisation. Beyond that what we need, may be an 18 sq.ft. pit (6'x3' approx.) to bury us. If our religious customs prescribe cremation for our body, we do not need even that. But Capitalism makes highly qualified persons blood suckers.

Question: You ybrao-a-donkey always seem to find fault with Capitalism for all the evils of the world, as if in your blindly adored Communism / Marxism / Total Socialism, there will be no corruption, and there will be no blood-suckers?


Ans: Even in complete Socialism, there is scope for Corruption. Events and history in Russia, China, erstwhile East Europe had proved that, and are proving that.

Prime Minister Narendra Modi has also repeatedly announced that the primary object of his DEMONETISATION OF HIGH VALUE INDIAN RUPEE CURRENCY NOTES made on NOv. 8, 2016, was to uproot out corruption. He has repeatedly publicised his 'man-ki-bath' (Word of the mind) that he will continue his fight against corruption, by urging citizens to shift to digital payments using Aadhar Cards. The Central Government has made digital payments compulsory for buying railway tickets at selected railway stations.

Now, we can see what the corruption of an Engineer-in-Chief, a Dy. Transport Commissioner (DTC), a Dy. Superintendent of Police (DSP) has got to do with purchase of train tickets online using x card or y card? Why did all these Officials behave like cannibals who are fond of 'nara mAmsam' (human flesh?), in spite of being highly qualified persons, enjoying in positions which enable them to make speeches to people?

According to my perception, the possibilities and tendencies of persons and institutions becoming corrupt are higher in CAPITALISM when compared to True Complete Socialism, because in Capitalism, one can accumulate Private Properties. With abundant money, one can purchase all the non-sensical goods which are available in the Euro-American World, and show them off to other not-so-fortunate fellow citizens. (These are also called 'goods of conspicuous consumption, and demonstration effect'). In truly Socialist Societies and countries, it will not be possible, because there will be no money, with the exception of, may be some coupons to take delivery of food, clothing, shelter, etc. necessities, some comforts.

CORRUPTION IS POSSIBLE EVEN IN TRULY SOCIALIST COUNTRIES AND SOCIETIES


Though, domestically, there may not be banks to stock ill-gotten wealth, or private properties to accumulate, still corruption is possible for those who can money-launder through under-invoicing of exports, over-invoicing of imports, arranging the difference (kickbacks) to be credited to secret numbered accounts in tax havens such as Switzerland, Island of Man, Singapore, Bahamas, British Virgin Islands etc. This happens both in Capitalist countries, and Socialist countries. As far as truly socialist/communist/marxist countries are concerned, this luxury of accounts abroad, everybody cannot have. It will be available only to top bosses.

938 Why Mr. Subramaniyan Swamy stresses on only one part of Article 48 of Constitution, ignoring the remaining part?


There is no political party in India, which can truly be called SECULARIST. Even Communist Parties cannot be considered really secular. Postures of political parties, depend on the vote-banks they address to at any particular given point of time. Consequently, the same political party can take different positions, in different States and different Regions, depending on the demographic mix of castes, religions, language, occupation, etc. at the specific place of the meeting / rally. We know Mr. Asaduddin Owaisi, and his Majlis Party depends for its survival on its highly communal Muslim base in Hyderabad Old City, whose religion that Party wants to exploit, but is not concerned about the backwardness, bigotry, illiteracy, poverty of the people living there, and consequently it thrives by enflaming communal hatred, though its leaders officially proclaim to abide by the Constitution of India. Mr. Asaduddin Owaisi, its leader, has a strong urge to become a National Leader. Such ambitions may not be wrong, as long as ethically supportable means are used to reach those goals.

After spectacular success in Uttar Pradesh Elections, BJP leaders and rulers all over the country have become rejuvanated


Though there is nothing wrong in trying to implement agendas and manifestos of the winning political party, it is to be done, with due care, after thoroughly examining pros and cons. Any hasty step can land countries in endless civil wars, and communal strife. Today, the world itself is in the midst of inter-religious wars.

Just as lot of foreplay takes place before a truly orgasmic sexual intercourse, lot of preparatory work will be necessary, before initiating reforms of any kind, howsoever beneficial they may be to the Nation. In this context, we can see how the Gujarat Government is bringing out a legislation to prescribe a punishment of min. 10 years, maximum lifer, to those who are caught in cow-slaughter. Madhya Pradesh Chief Minister also seems to be a person in a hurry.

Mr. Owaisi is such a politician who wants to take advantage of even a slight disparity which he finds as enough to instigate those who believe him. Ban on beef is one such opportunity to him. The lacuna he found is: BJP wants to enforce ban on cow-slaughter only in some states, and wants to be lenient in some other states like Goa, North Eastern States. To derive communal benefits from this variance, Owaisi has come up with some hasty observations, which may benefit him electorally, but does great damage to the communal harmony of the country. Compassion to animals, is an ancient trait in India. Before they became hunters, Ancient Indians were vegetarians. Though they had resorted to agriculture and animal husbandry, to derive benefit from milk, slaughter of miltch animals and draught animals was not a commercial activity for them. In ancient India, white animals seem to be rare species, till Aryans had apparently brought them from Europe (more evidence is required: both in case of cows and horses). Buffaloes (black animals) outnumbered the white animals.

In Sanskrit Vyasa Mahabharata's Yudhishthira's Horse sacrifice, there are verses which indicate bullocks were sacrificed.

In Sanskrit Vyasa Mahabharata, there are verses which indicate that King Ranti Deva fed Brahmins with 2000 cows every day, during 'cAturmasya vrata' (four months special worship).

Whatever be their past practices, Aryans have, may be by Buddhist/Jain influences, gradually started to revere cow as 'Mother', and tried to avoid cow-slaughter. There is nothing wrong in it. Had Muslim invasions not taken place, and had the European subjugation of India not taken place, probably we might have had by now, turned into a beef (of white animals) avoiding nation. Had we turned into cattle-compassionate Nation, aged and diseased cattle might have been allowed to die their natural death in villages, though that might have been a burden on rural economies. An alternative practice of dropping the dry/diseased/aged animals in forests- natural habitat, might have started as a via media solution.

This did not happen. Unfortunately, the Turkish, Moghul Islamic Invaders, the European Invaders, have complicated the problem, by making beef selling and exporting a profitable business.

Mr. Subramanian Swamy has ignored the second part of Article 48: (See above quote)


and other milch and draught cattle.. The other milch and draught cattle, mentioned in Article 48 of Constitution refers to black animals such as she buffaloes, and he buffaloes, camels.

Now, Mr. Subramanian Swamy, the Great Harvard Professor should answer: "Why only cows are mothers? Why not she buffaloes? Why he-buffaloes are not fathers?" . Why does not he seek a ban on slaughter of black animals i.e. BUFFALOES which outnumber cows. They are our real mothers and fathers, when compared to cows and bullocks.

If at all 'compassion towards animals' is to be encouraged, and Indians are to cultivate PITY AND EMPATHY, that must be done without discrimination of color 'white and black'. Justice should be done to all animals, whether they are cows or buffaloes or bulls or he-buffalos, camels. Then, the element of RELIGION can be removed. The quality of COMPASSION is expected to be SECULAR, GENTLER, AND NOBLER. In bringing this change, one should not forget that lot of intellectual upgradation of INdians will become necessary. SLOW AND STEADY WINS THE RACE.
